Superior Court Briefs: May 27 - June 4

Cases heard before Judge Mary Lou Rup on Tuesday, May 27.    

Radell Johnson, 28, of New Haven, Conn. had not guilty pleas entered on his behalf on three counts of conspiracy to violate drug laws, three counts of possession of a firearm during the commission of a felony, three counts of illegal ownership of a firearm, three counts of improper storage of a firearm, two counts of possession of ammunition without a firearm identification card and single counts of possession of cocaine with intent to distribute, possession of phencyclidine with intent to distribute and possession of marijuana with intent to distribute.

He was released on $2,500 bail. The charges stem from the execution of a search warrant on Columbus Avenue on March 27, 2014.

Cara Miller, of Williamstown, pleaded guilty to single counts of larceny an ongoing and continuing offense and embezzlement.

She was ordered to serve three months of a two-year sentenced and placed on three years probation. Mille took approximately $240,000 from Village Ambulance Service in Williamstown from January 1, 2006 and December 31, 2011.

Cases heard before Judge Mary Lou Rup on Wednesday, May 28.

Anthony Robertson, 32, of Schenectady, N.Y. had not guilty pleas entered on his behalf on single counts of illegal possession of a firearm, illegal possession of a loaded firearm, possession of ammunition without a firearm identification card, possession of a firearm with a prior conviction for a violent crime or serious drug offense, resisting arrest and receiving stolen property over $250.

He was ordered to be held at the Berkshire County House of Correction without the right to bail pending a dangerousness hearing. The charges stem from an incident in Pittsfield on May 3, 2014.

Erich Rawlins, 30, of Pittsfield had not guilty pleas entered on his behalf on single counts of armed robbery while masked, larceny of a controlled substance and larceny over $250.

He was ordered to be held at the Berkshire County House of Correction on $52,000 bail. Rawlins allegedly committed an armed robbery at the Elm Street Getty in Pittsfield on January 24, 2011. He is also accused of taking money on March 24, 2014 and drugs on April 11, 2014 in Pittsfield.

Tyrone Jenkins, 32, of Pittsfield had not guilty pleas entered on his behalf on three counts of assault by means of a dangerous weapon and single counts of home invasion, armed robbery and possession of phencyclidine.

He was ordered to be held at the Berkshire County House of Correction on $100,000 bail on the condition that he have no contact with the alleged victims. Jenkins is accused of committing a home invasion on April 21, 2009. The drug charge stems from his arrest on April 24, 2014.

Robin Houghtling, 20, of Pittsfield had a not guilty plea entered on his behalf on a single count of assault and battery by means of a dangerous weapon.

He was ordered to be held at the Berkshire County House of Correction on $10,000 cash or $100,000 surety bail. Haughtling allegedly assaulted a 46-year-old man in Pittsfield on February 13, 2014.

Cases heard before Judge John Agostini on Tuesday, June 3.

Barton Jones, 33, of Troy, N.Y. pleaded guilty to single counts of larceny over $250, assault and battery and assault.

Jones was sentenced to serve concurrent 17-month sentences at the Berkshire County House of Correction. The incident involved a 29-year-old man in North Adams on January 4, 2013.

Cases heard before Judge John Agostini on Wednesday, June 4.

Kirk Palmer, 49, of Pittsfield pleaded guilty to a single count of possession of cocaine with intent to distribute.

He was released on $500 bail pending sentencing on August 5, 2014. The charge stems from the execution of a search warrant at his home on November 21, 2013.

Pittsfield: Property Crime Up, Violent Down in April

PITTSFIELD, Mass. —  An "unusually high" number of commercial burglaries occurred during April, according to a report released from the Police Department.

The number of burglaries more than doubled over March. The month of April saw 43 burglaries compared to just 21 in March, which has been mostly characterized by a large number of motor vehicle burglaries.

"Although the rash of motor vehicle burglaries that we saw in March died down considerably this month, it was unfortunately replaced with an unusually high number of commercial burglaries," the Police Department wrote in a monthly "city stats" report.

Burglaries are still lower than they were at this point last year. In 2013, there were 131 and, so far this year, there have been 109. However, the number of burglaries in April are 23 percent above the five-year average.

"The average increase for burglaries between March and April is five cases, but this year we have had a 22-case increase. This spike, however, can be attributed to a rash of commercial burglaries we have had this past month," the report reads.

In nearly all types of property crime — from larceny to shop lifting to motor vehicle theft — the city was above the five-year average in the month of April. The only crime trending below is larceny from a person. 

Overall, April saw 135 cases of property crime compared to 100 last month. The property crime rate for April was 48 percent more than the five-year average.

Property crime has been on an uptick each month, but violent crime is significantly down.

"Recovering from some slipups last month, April has seen decreases in violent crime across the board," the report reads. "In all categories, April 2014 showed a 5 percent or higher decrease compared to the 5-year average (except for homicide, which has an average of 0 cases). The most notable difference, again, is the drastically smaller number of aggravated assault cases. Over the past five years, April usually brings an average of 12 aggravated assault incidents and this year, we have only had one."

There were two rapes, one robbery and one aggravated assault case in the city in April. The four total cases is down from nine last month.

Violent crime overall is down 78 percent in the month of April than the five-year average.
