Lanesborough News: Motocross Track Case in Housing Court

LANESBOROUGH — Peter and Michelle Beaudoin have been served a summons issued by the state Housing Court over noise complaints from their North Main Street property.

The Beaudoins constructed a motocross track last year but the Board of Health ordered them to stop using it after neighbors complained.

Town officials say the track has been used multiple times over the past months in violation of a cease-and-desist order from the Board of Health last fall. Peter Beaudoin was fined $850 on June 3 and $2,000 for four more violations since then. None of the fines have been paid the town counsel advised that the town could take the case to civil or criminal court.

The matter was filed in the Western District Housing Court in Springfield, which oversees cases for Berkshire, Franklin and Hampshire. The Housing Court has jurisdiction over the use of land and the activities conducted upon relating to health, welfare and safety issues according to the bylaws and ordinances of municipalities.

According to the Selectmen, the Beaudoins have 20 days to respond. The summons asks that they comply with the requirements of the Board of Health's cease-and-desist order of Oct. 23, 2007, and the June 4, 2008, order to pay fines.
 
The summons was issued by the Housing Court in response to a request for an emergency order filed by the Board of Health.
 

If there is no response the board will then have to file a motion with the court requesting a hearing on the matter.

Contract Awarded
 
The Senior Center Building Committee at its meeting on July 16 awarded a contract for a topographic survey and master plan of the site purchased by the town to White Engineering of Pittsfield.
 
The firm was the lowest bidder of three bids at $19,000. The other bids were Guntlow & Associates, $23,300, and Hill Engineers, $22,500. A warrant article was passed at the last town meeting authorizing the expenditure of up to $27,500 for this work.
 
A contract will be signed before the end of the month. It will take three to four months to complete the work.

Striking Out Cancer in Berkshires Holds Sunday Party Before June 27 Games

PITTSFIELD, Mass. – Striking out Cancer in the Berkshires has been bringing smiles for half a decade.
 
This year, it also is bringing Smiley.
 
A day of community baseball and softball games that act as a fund-raiser for the Jimmy Fund is the brainchild of Joe DiCicco, who has expanded the event’s footprint over the years and seen a steady growth in money raised as a result.
 
This year’s games are scheduled for 9:30 a.m. on June 27 on Buddy Pellerin Field at Clapp Park.
 
But the festivities begin this Sunday from 2 to 4 p.m. at the Sideline Saloon on Fenn Street, where DiCicco invites families to come down, free of charge, to take photos with a Boston Red Sox World Series Trophy and meet Boston mascot Wally the Green Monster and Smiley, the mascot of the Triple-A Worcester Red Sox.
 
“It’s just a little way to give back to the community to start the week,” DiCicco said. “Last year, we had the trophy for the first time, and they want to bring it back, so that’s a good thing. Wally is different, and so is Smiley.”
 
What has not changed is DiCicco’s dedication to the Dana-Farber Cancer Institute’s Jimmy Fund, inspired by Einar Gustafson, a child who beat cancer with the help of Dr. Sidney Farber in 1948 and shared his story with the world under the name Jimmy to protect his anonymity.
